Agreement to Terms
By accessing or using Broads Web Design services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.
Services Provided
Broads Web Design offers the following services:
- •Custom website design and development
- •Website redesign services
- •Website maintenance and support
- •Search engine optimization (SEO)
- •Ongoing technical support
Project Proposals & Quotes
All quotes provided are estimates based on the information provided at the time of inquiry. Final pricing may vary depending on project scope, revisions, and additional requirements discovered during the project. Any significant changes to pricing will be communicated and agreed upon before proceeding.
Payment Terms
Project Payments
For web design projects, a 50% deposit is required before work begins. The remaining 50% is due upon project completion and before the website goes live. Payment is accepted via bank transfer or other agreed-upon methods.
Maintenance Services
Monthly maintenance fees are billed at the beginning of each month and are payable within 14 days of invoice date. Failure to pay may result in suspension of services.
Switch & Redesign Special Offer
Customers who purchase a website redesign and switch their maintenance to us receive 3 months of free maintenance (value £180). This offer is available to new clients with existing websites only and cannot be combined with other offers.
Project Timeline
We strive to complete projects within the estimated timeframe discussed at project commencement. However, timelines may be affected by client feedback delays, scope changes, or unforeseen technical challenges. We will communicate any delays promptly.
Revisions & Changes
Each project includes a specified number of revision rounds as outlined in your project proposal. Additional revisions or major scope changes may incur additional fees. We encourage clear communication throughout the design process to minimize the need for extensive revisions.
Client Responsibilities
To ensure timely project completion, you agree to:
- •Provide all necessary content, images, and materials in a timely manner
- •Respond to feedback requests and questions within a reasonable timeframe
- •Provide access to necessary accounts, hosting, and domains as required
- •Ensure all provided content is legal and does not infringe on third-party rights
Intellectual Property
Your Content
You retain all rights to content you provide, including text, images, logos, and other materials. You grant us a license to use this content for the purpose of completing your project.
Our Work
Upon receipt of full payment, you own the final website design and code created specifically for your project. We retain the right to use project screenshots and descriptions for our portfolio and marketing purposes, unless otherwise agreed.
Third-Party Assets
Some projects may include third-party plugins, frameworks, or assets that are subject to their own licenses. These remain the property of their respective owners.
Warranties & Disclaimers
We warrant that services will be performed with reasonable skill and care. However:
- •We do not guarantee specific search engine rankings or traffic levels
- •We are not responsible for content accuracy provided by the client
- •Website performance may be affected by factors outside our control (hosting, internet connectivity)
Maintenance & Support
Our monthly maintenance packages include regular updates, security monitoring, backups, and technical support as outlined in your service agreement. Response times vary based on the urgency and complexity of the issue. Emergency support outside of standard maintenance may incur additional fees.
Termination
Either party may terminate a project or maintenance agreement with written notice. For ongoing maintenance, 30 days' notice is required. Upon termination, you are responsible for payment of all work completed to date. We will provide all files and access credentials upon receipt of final payment.
Limitation of Liability
To the fullest extent permitted by law, Broads Web Design shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount paid for the specific service in question.
Changes to Terms
We reserve the right to update these terms at any time. We will notify existing clients of any significant changes. Continued use of our services after changes constitutes acceptance of the new terms.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
